THE ROLE OF THE JUDICIARY IN SAFEGUARDING THE RULE OF LAW: RETHINKING THE NIGERIAN JUDICIAL SYSTEM

The Nigerian judiciary plays a crucial role in upholding the rule of law and safeguarding human rights. However, its effectiveness is often undermined by political interference, corruption, inefficiency, and limited access to justice for marginalized groups. This study adopted a scoping method to critically analyze legal documents, selected cases, and statutes to evaluate the competence of the Nigerian judiciary in delivering justice. While the Constitution guarantees judicial independence, centralized structures and insufficient resources hinder its full potential. Despite these challenges, the judiciary has made notable contributions, particularly in adjudicating electoral disputes and addressing corruption. However, these areas also highlight its most significant shortcomings, posing threats to Nigeria’s democratic aspirations. The study advocates for reforms to enhance judicial independence, efficiency, and accessibility. Key recommendations include establishing an independent judicial appointments commission, implementing whistle-blower protections, creating specialized courts, and fostering public-private partnerships (PPP) to improve infrastructure. These measures are critical to strengthening the judiciary's capacity to promote democracy and uphold the rule of law in Nigeria
