LAW AS INTEGRITY: THE BASIS FOR JUSTICE IN RONALD DWORKIN’S LEGAL PHILOSOPHY

Abstract

The inconsistencies in the rulings of the courts awake one to think, whether we h ave institutional history of state legal system or not? Legal liberalism is a school of thought in Jurisprudence which holds that the confidence in the ability of courts to change society for what judges believe is the best for the society. But reverse is the case in our judicial system. Dworkin, who belongs to this school of thoughts, pointed out that, a commitment to law as integrity upholds for a true community which brings justices to every citizen of the state. This paper, examines Dworkin’s concept of law as integrity: the basis for justice. The aim of this research is to discourse Dworkin’s concept of law as integrity as a background for justice in our society. Objectively, this paper would (a) it would expose what law is (b) discourse Dworkin’s legal departure, (c) law as constructive interpretation (d) law as integrity: basis for justice, And (e) also elaborate on his remedies to jurisprudence for peaceful co-existence in any sovereign state whether law as integrity is myth or reality? Using the qualitative design in this research, this work holds that, Dworkin’s concept of law as integrity will close the gap that leads to inconsistent in the interpretation of law in some sovereign state to some extend and to greater extend if applied from the point of view of proposed moderates legal theory of law, which reforms law as integrity to fit the third world countries
